The Supreme Court started a new term earlier this month amidst a good deal of saber rattling about its rulings from this year’s presidential candidates. Largely because of last term’s 5-4 same-sex marriage decision and its 6-3 ruling upholding the Affordable Care Act yet again, Republican candidate Ted Cruz has denounced the Supreme Court’s “long descent into lawlessness” and has called for a constitutional amendment to subject Supreme Court justices to periodic retention elections to rein in their “assault on the rule of law.” Other Republicans have joined the chorus. Carly Fiorina has called the same-sex marriage ruling just “the latest example of an activist Court ignoring its constitutional duty to say what the law is and not what the law should be.” Mike Huckabee has said that he would not necessarily follow Supreme Court rulings as President, vowing never to “bow down to the false gods of judicial supremacy.” Bobby Jindal has gone even further, calling the Court “completely out of control” and adding: “If we want to save some money, let’s just get rid of the Court.” Jeb
